GENERAL TERMS AND CONDITIONS OF SALE (hereinafter the "GTS")

1 – DEFINITIONS

 

For the purposes hereof, the following terms are defined as follows:

    • 1.1 – Pack or Card: prepaid offer comprising a defined number of lessons, valid for a specified period indicated at the time of purchase. Additional options (e.g. extended validity, change of city) are available under certain conditions.
    • 1.2 – Subscription: contract automatically renewable every 4 weeks, with or without commitment, including a fixed number of lessons. Payment is made by credit card or direct debit via the Bsport platform. Cancellation is possible under the conditions specified in article 12.
    • 1.3 – Price: financial conditions relating to the purchase of a product (pack, subscription, discovery course, etc.), displayed on the platform when the order is placed. Promotional offers may be available subject to specific conditions.
    • 1.4 – Customer: individual or legal entity making a purchase via the Bsport platform, on its own behalf or on behalf of a third party (e.g. a parent for his or her child).
    • 1.5 – Affiliate: independent structure operating the Swim Stars brand locally. Each affiliate is identified on the corresponding pool sheet on the www.swimstars.co website , with the words “Independent affiliate Swim Stars France”. He is solely responsible for the performance of the service sold.
    • 1.6 – Swim Stars France: Green Hope, publisher of the www.swimstars.co website and operator of the Swim Stars brand. It acts as a technical and commercial platform, centralizing sales on behalf of affiliates.
    • 1.7 – Coach: State-qualified swimming instructor, recruited and supervised by the local affiliate to run on-site courses.
    • 1.8 – Bsport : Bsport S.A.S., the technical service provider supplying the booking platform, the Swim Stars mobile application and the payment interface. All purchases, reservations and payments are made by Bsport on behalf of the affiliates.
 

2 – PRESENTATION OF THE SWIM STARS NETWORK


 

Swim Stars France is a national platform grouping together a network of independent affiliates, each operating under their own responsibility in the pools listed on the www.swimstars.co website.

The role of Swim Stars France is to coordinate the brand, digital tools and administrative processing of sales.

The General Terms and Conditions apply to purchases made via the Bsport platform accessible on the website or via the Swim Stars application. The service (lessons) is provided exclusively by the local affiliate whose name appears on the pool sheet when the order is placed.


3 – PLACING AN ORDER


 

3.1 – Orders are placed exclusively online via the Bsport booking platform, accessible at www.swimstars.co or via the Swim Stars mobile application.


3.2 – The purchasing process comprises the following stages:

  1. Product and affiliated pool selection
  2. Display contractual information (GTC, pricing conditions, affiliate ID)
  3. Basket validation
  4. Choice of payment method
  5. Order confirmation
 

3.3 – In the case of payment by SEPA direct debit, the order becomes final after bank validation. In the case of promotions, the code must be entered and activated via the Bsport interface.


3.4 – Once the order has been validated, a summary email is sent automatically via the Bsport platform. Details of the order can be consulted in the customer’s personal space.


3.5 – The service contract is formed between the Customer and the local affiliate, Swim Stars France acting only as an intermediary.


4 – PRICES


 

Prices are displayed in euros, all taxes included, on the www.swimstars.co website .


They may vary from one pool to another, depending on the affiliate, the type of course, the schedule and the target audience.


The total price, including any additional charges, is recapitulated before final validation of the order.


Swim Stars France and its affiliates reserve the right to change prices at any time. The prices applied are those in force on the date of the order.


In the event of an obvious error (bug, inconsistent price), the order will be cancelled and the Customer will be informed as soon as possible. He will then be able to reorder at the corrected price.


5 – COURSE AVAILABILITY


 

Services are subject to local availability, which depends on :

  • of the basin’s capacity,
  • slots opened by the affiliate,
  • the effective presence of the coaches.
 

In the event of unavailability (slot cancelled, coach absent, exceptional closure, etc.), the local affiliate undertakes to offer a rescheduling solution or to credit the course concerned.

Swim Stars France is not responsible for incidents related to local organization.


6 – PAYMENT


 

6.1 – Available payment methods

Orders are paid exclusively via the Bsport platform, on behalf of the local affiliate identified on the pool sheet.

Accepted means of payment are :

  • Credit card (CB, Visa, Mastercard, AMEX)
  • SEPA Direct Debit
  • ANCV vacation vouchers and ACTOBI coupons (depending on pool)
  • Customer service credit note
 

All payments are collected and processed by Bsport S.A.S., which acts as technical service provider for the entire Swim Stars network.

6.2 – Payment security

 

Transactions are secured via the payment service providers integrated into the Bsport platform, in compliance with PCI DSS standards.

No banking data is stored by Swim Stars France or its affiliates.

In the event of suspected fraud, the order may be suspended or cancelled.


7 – COURSE USE AND PLANNING


 

Courses must be booked via the customer’s personal space on the Bsport platform.

Each reservation is :

  • Nominal (student’s name),
  • Non-transferable without the written agreement of the local affiliate,
  • Subject to local operating conditions as indicated on the pool data sheet.
 

The local affiliate is solely responsible for the organization, course content, timetables and management of the coaches.


8 – CANCELLATIONS, ABSENCES AND POSTPONEMENTS


 

8.1 – Cancellation by the Customer

Customers can cancel a lesson up to 4 hours before the scheduled time, directly from their personal space.

  • If the cancellation is made within this period, the credit is automatically reactivated.
  • In the event of late cancellation or unjustified absence, the credit is lost.
  • Credit recovery is only possible on presentation of a medical certificate in the beneficiary’s name, sent within 72 hours.

8.2 – Cancellation by local affiliate

If a course is cancelled by the affiliate (coach absent, technical problem, temporary closure, etc.), the course credit is automatically reactivated on the customer’s account.

No refunds will be made for local cancellations, except in cases covered by article 9.


9 – VALIDITY, POSTPONEMENT AND REFUND


 

9.1 – Period of validity

  • Packs (or course cards) have a fixed validity period, indicated at the time of purchase.
  • Subscriptions are valid for periods of 4 weeks, renewable by tacit agreement.

The validity date begins on the date of purchase or first invoice.

9.2 – Extension of validity

A deferment of validity may be granted:

  • In the event of physical incapacity of more than 30 days (medical certificate required, sent before end of validity),
  • In the event of exceptional closure (e.g. maintenance, force majeure), outside scheduled vacations.
 

9.3 – Refunds

A refund is only possible in the following cases:

  • Permanent closure of the pool operated by the affiliate from whom the purchase was made,
  • And no other swimming pool managed by the same affiliate within a 15-kilometre radius.
 

In this case :

  • A credit note valid for 1 year is first issued,
  • If the affiliate does not resume business within this period, the customer may request a refund of unused credits.
 

⚠️ The presence of another Swim Stars pool managed by another affiliate is not considered a valid alternative.

9.4 – Cases excluding reimbursement

No refunds will be given in the following cases:

  • Credits not used within the allotted time,
  • Temporary closure or slot change,
  • Failure to attend or cancel the course on time,
  • Products purchased on special offer,
  • Relocation if a pool managed by the same affiliate exists within a 15 km radius.
 

10 – LIABILITY


 

Swim Stars France (Green Hope) acts as a technical, commercial and administrative platform, via the www.swimstars.co website and the Bsport S.A.S. company.

Services are provided exclusively by the local affiliate, identified on the site’s pool sheet.

Swim Stars France shall not be held liable for any damages:

  • The organization or quality of the courses,
  • Schedule changes or local closures,
  • Incidents or disputes arising in the pool or with local staff.
 

Contractual responsibility lies solely with the local affiliate, with whom the Customer is contractually bound.


11 – RIGHT OF WITHDRAWAL


 

11.1 – General terms and conditions

In accordance with article L221-18 of the French Consumer Code, the customer has a period of 14 clear days from validation of the order to exercise his right of withdrawal, without having to justify his reasons or pay any penalties.


11.2 – Special cases

  • If the Customer books and consumes a first course before the end of the 14-day period, he expressly waives his right of withdrawal for the part consumed.
  • Purchases of promotional products are non-refundable, even in the event of withdrawal. An equivalent credit note may be offered subject to acceptance by the affiliate.
 

11.3 – Terms and conditions of exercise

The retraction request must be made in writing via the chat on the relevant pool sheet (accessible from www.swimstars.co/piscines-swim-stars).

No other channel is valid.

Refunds are made by Bsport within 14 days of receipt of the request, provided that the Customer has not used all or part of the service.


12 – TERMINATION OF CONTRACT (SUBSCRIPTIONS)


 

12.1 – Procedure

Subscriptions can be cancelled by sending a written request to the pool’s chat room.


12.2 – Notice period

  • For non-binding subscriptions: cancellation takes effect on the next due date, subject to 15 days’ notice before the next billing date.
  • For subscriptions with commitment: cancellation is possible at the end of the commitment period. Any early request must be justified (e.g. moving out of the area covered, medical incapacity).
 

12.3 – Month started

Any month started is due in full, even if you request cancellation.


13 – PROOF OF ORDERS / ARCHIVING


 

All orders, reservations and payments are managed by the Bsport S.A.S. platform, which records customer account data.

The information contained in the Bsport database is authoritative in the event of a dispute, except in the event of a manifest error proven by the customer. These data have the same legal value as any written and signed document.


14 – DISPUTES AND LIABILITY


 

14.1 – Local liability

Any dispute concerning the quality of service, the organization of lessons, cancellations or incidents in the pool must be dealt with in priority with the local affiliate, identified on the pool form.

Swim Stars France (Green Hope) can only intervene if the dispute concerns :

  • a malfunction of the Bsport platform,
  • a payment error,
  • an access or account management problem.
 

14.2 – Mediation

If amicable resolution fails, the Customer may refer the matter to FEVAD’s e-commerce mediator:

 

French law applies to all claims.


15 – PERSONAL DATA PROTECTION


 

The data collected at the time of the order is processed by Swim Stars France and Bsport S.A.S. in compliance with the RGPD and the “Informatique et Libertés” law.


15.1 – Purpose

The data is used solely for :

  • reservation and payment management,
  • communication with the customer (emails, notifications),
  • accounting or legal obligations.

No data is shared with unauthorized third parties.


15.2 – Customer’s rights

Customers have the right to access, rectify, delete, port and object to the use of their personal data.

These rights may be exercised by e-mail to: reclamation@swimstars.fr, with proof of identity.

Swim Stars reserves the right to refuse any abusive request.


16 – CLAIMS HANDLING / MEDIATION

 

For any claim, the Customer may :

  • contact the local affiliate directly via the pool form chat on www.swimstars.co,
  • or write to Swim Stars centralized support if the problem concerns the platform (payment, access, customer account).
 

In the event of an unresolved dispute, mediation may be initiated (see article 14.2).


17 – DISCOVERY COURSE


 

The Discovery Course is a one-time offer per student and per affiliate.

It is reserved for new customers who have never taken a course in the affiliated pool concerned.

Any abuse or attempt to cumulate with other affiliated structures may result in automatic cancellation of the reservation, without refund.
